CUSTOMS CONTROL Items and substances banned for importation (sending) Audio and video materials Clearance of the unaccompanied luggage Animals Items banned for importation (sending) into Ukraine:
• transport facilities, which at the moment of importation were made 5 and more years ago, for their permanent use in the territory of Ukraine, with the purpose of disposal, disassembly for spare parts, except for the above cases; • strong, poisonous, radioactive, explosive substances, other items which can cause harm to the health or threaten the life of the population and animal life or result in infection, destruction of natural environment; • printed materials, cliches, negatives, finished shooting films, photographic pictures, films, video recordings, copies of magnetic information for computers, manuscripts, discs and other sound recordings, figures, other printed and graphic material containing propagation of ideas of war, racism, racial discrimination and genocide and others contradicting the relevant norm of the Constitution of Ukraine; • items (products) whose export is banned in conformity with the Ukrainian law; • items (products) whose import is made with infringement of the industrial or intellectual property rights; • food products without the certificate of conformity sent in the international mail. Items banned for export from the customs territory of Ukraine:
• items (products) subject to state grants, except for items of personal use; • precious metals, precious stones, and products made of them, cultural values with the purpose of disposal; • strong, poisonous, radioactive, explosive substances, other items which can cause harm to the health or threaten the life of the population and animal life or result in destruction of natural environment; cancelled securities. Items (products) which are subject to veterinary, ecological, sanitary or phytosanitary control shall be passed upon accomplishment of such control by the relevant services. Items banned to transit through customs territory of Ukraine:
• weapon and ammunition of all types, military equipment; • aircraft, their parts, devices, and equipment thereto; • machine tools and machines, intended for manufacturing of weapons, ammunition of any type and aircraft, spare parts thereof; • narcotic facilities; • radioactive items and substances; • strong, poisonous and explosive substances, other items which may cause harm to the health or threaten the life of the population and animal life or result in destruction of the natural environment; • items (products), banned to importation in Ukraine in conformity with the Ukrainian law. Audio and video materials
The procedure for movement of media governed by the State Customs Committee of Ukraine Order No.99/252 dated August 22, 1994. This Order approved the Instruction "On the procedure of movement across the national border of Ukraine text, audio, and audiovisual materials". This is the core interdepartmental document, which specifies the general procedure of movement across the customs border of printed periodicals, manuscripts, scientific and technical products, original copies and copies of personal documents, audiovisual material, still and motion pictures by public authorities, associations of citizens, companies, and organizations of all ownership forms and national of Ukraine or foreign states. The inspection of the media is made with the purpose to prevent movement across the national border of the following: a) information protected by the Law of Ukraine "On State Secret", "On Information", and also other information, treated as a state secret based on the decision of the state experts on secret; b) materials containing calls to violent revolution or change of the government and social order, infringement of the territorial integrity, sovereignty and security of Ukraine, propaganda of war, violence and cruelty, racial, national, religious exclusion or intolerance, instigation to committing of criminal acts; c) material containing descriptions of methods for manufacturing and use of drugs and strong poisonous substances; d) products of pornographic and vulgar content. In cases when the media presented to the customs contain information not intended for general distribution, they should be accompanied with the additional permit. Individuals should submit media for control in advance. Submitting media to control, their owners shall fill in two copies of the customs declaration (Form MD-4), which specifies the number and type of media, passport data of the individual, country, to which they move, and declares that they contain no banned information. In respect of the term of control: it this depends on the number and type of the media. Therefore, they shall be submitted to the customs in advance. Having inspected the media, the inspector shall put on them customs clearance (seals, stamps and the like) and specify the results of inspection in Declaration MD-4. A copy of the filled in declaration shall be issued to the owner of the media together with the inspected media. The term of validity this declaration is one year. Luggage Procedure of customs clearance of unaccompanied luggage moved across the customs border of Ukraine 1. General provisions This Procedure governs customs clearance of the unaccompanied luggage, which belongs to nationals of Ukraine, foreigners and stateless persons. Unaccompanied luggage ("UL") shall include items send by their owner (or on his/her assignment by another individual or legal entity) and cross the customs border of Ukraine separately from the owner. 2. Procedure of customs clearance at UL importation into Ukraine
2.1 The fact of UL sending abroad is specified in the passenger customs declaration, which shall be filled in by the owner in 2 copies at the border customs into Ukraine. A copy of the passenger customs declaration certified by the personal number seal of the customs inspector shall rest with the UL owner and the second copy thereof shall be kept in the customs files. 2.2 Receiving UL, the owner shall present the passenger customs declaration, which specifies UL, items, currency and values, passed at the time of entry into Ukraine. 2.3 In case of receipt of UL by an individual acting on assignment of the owner, this individual shall present the passenger customs declaration made by the UL owner and the relevant notarized certified assignment. 2.4 Charging the import duties and other fees for items being a part of UL, they shall take into account the value of the products and other items imported into Ukraine by the national in person with indication of them in the passenger customs declaration. 3. Procedure of customs clearance at exportation of UL abroad of Ukraine
3.1 Customs clearance of UL is provided in the customs at the place of location of the owner thereof (as per the place of residence registration). 3.2 Sending UL abroad of Ukraine, the owner thereof or another individual acting under the notarized assignment of the luggage owner, shall fill in the passenger customs declaration in 3 copies, which specify the data on the items, currency and values in UL. 3.3 Upon registration of UL, the first copy of the passenger customs declaration shall rest with the UL owner or individual acting on assignment of the UL owner, the second shall be kept in the customs files, and the third shall be attached to the UL shipment documents. Items (products) whose importation in Ukraine requires importation permits issued by the relevant bodies: • dogs: the veterinary health certificate and international cynology certificate (passport), issued by the Cynology Union of Ukraine or branch thereof; • live animals: the veterinary health certificate of the State Committee of Ukraine for Standardization, Metrology, and Certification; • items (products) which are subject to veterinary, ecological, sanitary or phytosanitary control shall be passed upon accomplishment of such control by the relevant services. |
